To protect the integrity of our vehicle inventory and corporate data, the following practices are strictly prohibited without our explicit written permission:

- Data Mining: The systematic harvesting or indexing of our vehicle database.
- AI & Machine Learning: The use of the content, images, and data from this website for training algorithms, Large Language Models (LLMs), or artificial intelligence.
In the event of violations, DEMEESTER BV reserves the right to immediately block access to the website and demand compensation for the unauthorized use of its infrastructure and data.
3. Limitation of Liability (Disclaimer)

PART 2: SPECIFIC SALES PROVISIONS (WARRANTY & LIABILITY)
The articles below supplement our general terms and conditions of sale and apply in full to all transactional agreements, order forms, and invoices of DEMEESTER BV.
Article A: Sale in the Condition as It Is ("As Is" - B2B & Export)
Every sale to a buyer acting in the context of their professional or commercial activity (B2B), as well as any sale intended for export, takes place explicitly in the condition in which the vehicle is located ("as is"), which is known and accepted by the buyer. DEMEESTER BV grants no warranty whatsoever to professional buyers, neither for visible nor for hidden defects (in accordance with Art. 1641 et seq. of the Belgian Civil Code). The vehicle is primarily sold for repair, parts, or export. The buyer declares to possess the necessary technical expertise to thoroughly inspect the vehicle and any (accident) damage prior to purchase and to assess the associated risks.
Article B: Damaged Vehicles and Accident Cars
If the vehicle sold is explicitly offered and sold by DEMEESTER BV as a "damaged vehicle", "accident car", or "vehicle to be repaired", the buyer is fully aware that the vehicle exhibits technical, mechanical, electronic, or bodywork damage. The buyer accepts that the purchase price has been determined in proportion to this damage and the necessity of repair. The already existing damage, its direct or indirect consequences, as well as all defects that may reasonably result from the accident or the standstill of the vehicle, are therefore completely excluded from any form of indemnification or legal warranty.
Article C: Warranty for Sales to Consumers (B2C)
In accordance with legal provisions regarding consumer protection in the sale of consumer goods, private buyers (consumers) enjoy a legal warranty for any lack of conformity existing at the time of delivery of the vehicle. Insofar as it concerns a used vehicle (second-hand, ex-leasing), this warranty period is explicitly limited to twelve (12) months from the date of delivery. Any defect that manifests itself after the expiry of this one-year period shall be borne exclusively by the buyer. The warranty under no circumstances covers normal wear and tear, defects caused by incorrect use, or defects that the buyer knew or reasonably should have known at the time of the sale.
Article D: Reservations and Payment Restrictions
Vehicles can only be reserved upon payment of a formal deposit, which must be received within twenty-four (24) hours of the reservation request. If the deposit is not received within this timeframe, the reservation will automatically expire, and the vehicle will be made available to other buyers. In accordance with Belgian anti-money laundering legislation, cash payments are strictly limited and can never exceed a maximum amount of €3,000 per transaction/vehicle.
Article E: Vehicle Condition, Inspection, and Multimedia Disclaimer
Unless expressly agreed otherwise in writing, all vehicles listed on this website are sold unrepaired, without a valid certificate of roadworthiness (no MOT / 'keuringvrij'), and will not be delivered. Potential buyers are strongly advised and expected to inspect the actual, physical state of the vehicles on-site prior to purchase. If a buyer nevertheless chooses to purchase a vehicle based solely on the multimedia files (such as pictures, videos, etc.) available on this website, they explicitly waive the right to claim afterwards that the physical condition of the vehicle differs from the multimedia presentation. Discrepancies regarding hidden shortcomings, unnoted damages, pre-existing wear, or cosmetic differences can never constitute grounds for any form of compensation, reimbursement, price reduction, or cancellation of the sale.
PART 3: APPLICABLE LAW AND JURISDICTION
Belgian law applies to this website, its terms of use, and all contractual relationships of DEMEESTER BV. In the event of a dispute, the courts of the judicial district in which the registered office of DEMEESTER BV is located (Ypres/Kortrijk) shall have exclusive jurisdiction.
